OFCCP Posts Corporate Scheduling Announcement List

According to updates released by the Office of Federal Contract Compliance Programs (OFCCP), their Corporate Scheduling Announcement List (CSAL) Frequently Asked Questions page contains new information and the list of Federal Contractors selected for a Compliance Evaluation is now available in the 2019 Supply & Service Scheduling List.

The OFCCP is required to post the CSAL list in an accessible electronic format, as it is frequently requested and is not covered under any of the FOIA exemptions. Fiscal Year 2019 will be the first year the agency relies solely on this electronic notification of CSALs rather than mailing out physical letters to contractor establishments.

All Federal Contractors should review the list to determine if they have been selected for a compliance evaluation.

OFCCP to Post Corporate Scheduling Announcement List in March

OFCCP to post CSAL List on Website

OFCCP is on schedule to post its next Corporate Scheduling Announcement List (CSAL) in OFCCP’s FOIA Library in mid-to-late March 2019.  In addition to compliance reviews, the new list will include Section 503 Focused Reviews as outlined in our Focused Review Directive (DIR 2018-04) and compliance checks as outlined in our Affirmative Action Program Verification Initiative Directive (DIR 2018-07). OFCCP also will soon post on its website additional Section 503 contractor compliance assistance resources to help contractors prepare for the upcoming reviews.
This will be the first time OFCCP only posts the CSAL in the FOIA Library and does not mail advanced contractor notifications to individual establishments. Therefore, we strongly encourage contractors to subscribe to OFCCP Email Updates through our website to receive timely notification of the CSAL and other compliance assistance resources real-time.

OFCCP Issues Corporate Scheduling Announcement Letters

Earlier this month, the OFCCP began issuing CSAL letters directly to contractor establishments. They are providing this courtesy letter alerting contractors of upcoming OFCCP audit Scheduling Letters (which actually begin an audit) that they "may" be selected for an audit. In our experience, at least 90% of the time, organizations that receive this "heads up" letter will typically be scheduled for an audit within the following few weeks to up to six months or more.

With this round of CSALs, the OFCCP has further reduced the number of audits it seeks to annually undertake to perhaps only 1300 per year, down from the usual 4,300+. The OFCCP has undertaken approximately 500 already started in the first 5 months of this Fiscal Year 2017 and 800 anticipated in the last 7 months of this Fiscal Year.

To spread work more evenly across different OFCCP District Offices, OFCCP had recently begun to have its District Offices audit not only beyond their normal geographical District boundaries, but also across Regional Office lines (i.e. the Portland OFCCP Office may audit in Florida or the Jackson, Mississippi OFCCP District Office may audit in the Mid-west). This round of CSALs continues and expands that "out-of-District" audit approach.

OFCCP to Send Next Round of CSALs

The Office of Federal Contract Compliance Programs (OFCCP)will be sending Courtesy Scheduling Announcement Letters to HR directors (or designated points of contact) at 2,500 federal contractor establishments.  

Contractors may confirm whether one of their establishments was mailed a CSAL by faxing a written request on company letterhead to OFCCP’s Division of Program Operations at (202) 693-1305. Corporate Scheduling Announcement Letters Announced

The Office of Federal Contract Compliance Programs (OFCCP) released the Corporate Scheduling Announcement Letters (CSAL). These letters are addressed to the HR Director and sent to the individual establishments, not the corporate headquarters. This type of communication is a "heads up" to federal contractors on OFCCP's audit list, and notice of an audit usually follows shortly after the notification letter. Federal contractors with multi-establishments should remind locations to quickly notify their AA contact if they receive a letter from OFCCP.

There are a total of 2,193 establishments on the FY 2014 Scheduling List. Based on the 2-digit NAICS code, the FY 2014 Scheduling List covers 17 industries.

OFCCP Makes Public Audit Notifications Sent to Contractors

To the dismay of many federal contractors, OFCCP has announced that they will make public contractor establishments that will receive the Corporate Scheduling Announcement Letters (CSALs).

The CSALs provide employers with advance notice of the locations targeted by OFCCP for Audit. The CSAL does not initiate an audit and will be followed by a "scheduling letter" The Scheduling Letter is a standardized information request by OFCCP. Contractors must provide their affirmative action plan to OFCCP within 30 days of receiving a scheduling letter.

CSALs are sent directly to the facility to be audited, and, are simply addressed to "Human Resources Director".

OFCCP Sends Out Pre-Scheduling Notices

The Office of Federal Contract Compliance Programs has sent out Corporate Scheduling Announcement Letters (“CSALs”) to individual establishments identified for upcoming compliance reviews.The pre-scheduling notices we've seen were directed to the specific facility that will be undergoing a review and not to a corporate headquarters location. Federal contractors and subcontractors should be on the lookout for these letters.  

The current round of pre-scheduling notices, like the CSALs OFCCP had been using, are NOT formal letters opening compliance reviews (i.e. "scheduling letters"). The purposes of the CSALs are to:
  • Provide the contractor establishment’s internal EEO staff notice to obtain management support for EEO and self-audit efforts;
  • Encourage contractors to take advantage of OFCCP compliance assistance offerings;
  • Encourage contractors to focus on self-audit efforts that, if problems are adequately analyzed and corrected, saves OFCCP time/resources when we do an evaluation; and
  • Help contractors manage/budget the amount of time required for evaluation activity.
We encourage companies that receives a pre-scheduling notice to monitor the implementation of their AAPs and inform company representatives of the potential for a compliance review in the near future.

The OFCCP's Early Warning System - Did You Get One?

Corporate Scheduling Announcement Letters (CSAL), dated June 29th, have been sent by the Office of Federal Contract Compliance Programs (OFCCP).

The OFCCP has developed the CSAL to keep federal contractors informed in the event of a potential compliance evaluation. If there is an actual compliance evaluation, federal contractors will receive a scheduling letter, with detailed submission instructions on what to submit for evaluation within a 30 day timeframe.

The CSAL, generally addressed to the Chief Executive Officer, is notification to a corporation that one or more of its establishments are on the list of contractor establishments selected to undergo a compliance evaluation during the scheduling cycle. The CSAL should be considered an "early warning" of a compliance evaluation at ANY establishment within your company. If your company has received a CSAL, it is critical that preparations begin now.

Catching Up After the Holidays

CORPORATE SCHEDULING ANNOUNCEMENT LETTERS (CSAL) SENT

Be on the look-out for the latest round of Corporate Scheduling Announcement Letters sent by the Office of Federal Contract Compliance Programs (OFCCP) on December 20. A CSAL is notification to a corporation that one or more of its establishments are on the list of contractor establishments selected to undergo a compliance evaluation during the scheduling cycle. It is not a letter scheduling a compliance evaluation. Read more about CSAL here.

VETS100/100A FILING DEADLINE EXTENDED

The filing deadline for VETS-100/100A reports in the 2011 cycle has been extended to January 15, 2012. At that time the VETS-100 application will be removed from public service until further notice.

UPDATED OFCCP EMPLOYMENT RESOURCE REFERRAL DIRECTORY (ERRD) NOW AVAILABLE

The OFCCP has updated its Employment Resource Referral Directory (ERRD) that lists references to assist in hiring of qualified applicants. This directory is designed to reinforce the "Linkage Program" by listing hundreds of organizations that can provide workers having a variety of job skills and capabilities and are work ready. The directory may be accessed at http://www.dol-esa.gov/errd/index.html.

NLRB POSTPONES EFFECTIVE DATE OF RIGHTS POSTING RULES AGAIN

The National Labor Relations Board has agreed to postpone the effective date of its employee rights notice-posting rule at the request of the federal court in Washington, DC hearing a legal challenge regarding the rule. The Board's ruling states that it has determined that postponing the effective date of the rule would facilitate the resolution of the legal challenges that have been filed with respect to the rule. The new implementation date is April 30, 2012.
