In practice, employers who misclassify workers deny them full wages earned and important protections, such as workers’ compensation and unemployment insurance, both of which are afforded to workers classified as employees. Employee payroll taxes are also not paid by employers who misclassify workers, enabling them to avoid federal and state tax liabilities. Since 2013, the division’s Phoenix District Office has recovered more than $3.7 million in back wages and liquidated damages for thousands of Arizona construction workers. The majority of the affected employees are piece-rate, electrical and drywall workers paid as independent contractors or other types of non-employee misclassifications.
